1. Introduction

Welcome to Kearny Self Storage. These Terms and Conditions ("Terms") govern your use of our self-storage facilities and services. By accessing or using our services, you agree to be bound by these Terms. If you do not agree to these Terms, please do not use our services.

2. Definitions

  • "We," "Us," "Our" refers to Kearny Self Storage and its affiliates.
  • "You," "Your," "Customer" refers to the person or entity using our storage services.
  • "Unit" refers to the storage space rented by you.
  • "Rental Agreement" refers to the contract between you and Kearny Self Storage for the rental of a storage unit.

3. Rental Agreement

Your rental of a storage unit is subject to a separate Rental Agreement that you must sign. These Terms supplement and are incorporated into your Rental Agreement. In case of any conflict, the Rental Agreement shall prevail.

4. Eligibility

You must be at least 18 years old to rent a storage unit. You represent and warrant that you have the legal capacity to enter into this agreement and that all information provided to us is accurate and complete.

5. Payment Terms

  • Rent is due on the first day of each month or as otherwise specified in your Rental Agreement.
  • Late fees may apply if payment is not received by the due date.
  • We reserve the right to charge a late fee as specified in your Rental Agreement.
  • All fees are non-refundable unless otherwise stated.
  • We accept payment by credit card, debit card, check, or other methods as specified.

6. Prohibited Items

You may not store the following items in your unit:

  • Flammable, explosive, or combustible materials
  • Hazardous or toxic substances
  • Perishable food items
  • Live animals or plants
  • Illegal items or contraband
  • Items that produce odors or attract pests
  • Firearms, ammunition, or explosives
  • Items with a value exceeding the limits specified in your Rental Agreement

7. Access to Storage Unit

  • You will be provided with access codes or keys as specified in your Rental Agreement.
  • Access hours may be restricted and are subject to change with notice.
  • We reserve the right to restrict access if your account is in default.
  • You are responsible for maintaining the security of your access codes and keys.

8. Default and Remedies

If you fail to pay rent or violate any term of this agreement, we may:

  • Deny access to your unit
  • Charge late fees and administrative costs
  • Exercise our lien rights as permitted by law
  • Terminate your Rental Agreement
  • Dispose of stored items in accordance with applicable law

9. Limitation of Liability

To the maximum extent permitted by law, Kearny Self Storage shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or use, arising out of or related to your use of our services.

10. Insurance

You are responsible for maintaining adequate insurance coverage for your stored items. We do not provide insurance coverage for your stored property. You acknowledge that we are not responsible for loss or damage to your stored items.

11. Termination

Either party may terminate the Rental Agreement with proper notice as specified in the agreement. Upon termination, you must remove all items from the unit and return it in the same condition as when received, subject to normal wear and tear.

12. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify you of any material changes. Your continued use of our services after such notification constitutes acceptance of the modified Terms.

13. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which the storage facility is located, without regard to its conflict of law provisions.
